TERMS AND CONDITIONS OF SALE

1. Acceptance of the general conditions of sale and conclusion of the contract

1.1 The offer and sale on the Site of the Products constitute a distance contract governed by Chapter I, Title III (Articles 45 et seq.) of Legislative Decree September 6, 2005, No. 206 (“Consumer Code”) and Legislative Decree April 9, 2003, No. 70, containing the regulation of electronic commerce.

1.2 These Terms and Conditions apply to all sales made by Simplicitas di Antonella Pagano on the Site (www.simplicitascollection.com).

1.3 The General Conditions of Sale may be changed at any time. Any amendments and/or new conditions will be in force from the moment they are published on the Site, in the “Conditions of Sale” section. Users are therefore invited to regularly access the Site and consult the most up-to-date version of the General Conditions of Sale before making any purchase.

1.4 The applicable General Terms and Conditions of Sale are those in effect on the date the purchase order is submitted.

1.5 The contract entered into between Simplicitas di Antonella Pagano (hereinafter “Simplicitas”) and the Customer (i.e. the person, natural person, who makes the purchase on the Site, not referable to its commercial, entrepreneurial or professional activity) shall be deemed concluded with the acceptance, even partial, of the order by Simplicitas. In the event of non-acceptance of the order, Simplicitas shall in any event promptly notify the Customer.

1.6 By placing an order in the various ways provided, according to the order form on the Site (hereinafter the “Order”), the Customer declares that he/she has read all the indications provided to him/her during the purchase procedure and fully accepts these general conditions (hereinafter the “Conditions”).

1.7 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree. 206/2005, as amended by Leg. 21/2014.

2. Mode of purchase.

2.1 The products offered for sale by Simplicitas are only those on the Simplicitas website at the time the Order is placed, as described in the relevant information sheets.

2.2 It is in any case understood that the images accompanying the descriptive sheet of a product are for information purposes only and may not be perfectly representative of its characteristics but differ e.g. in color and size (also due to the browser and monitor used to access the Site and view the images).

2.3 In order to place an Order, the Customer shall fill out in its entirety the relevant form on the Site and submit it after carefully reviewing the Conditions, as well as the characteristics of the product and/or products it intends to purchase. The Customer must also request from Simplicitas, if it wishes, the issuance of a tax invoice relating to the purchase, pursuant to Article 22 Presidential Decree No. 633/1972.

2.4 The correct receipt of the Order is confirmed by Simplicitas by means of an e-mail response, sent to the e-mail address provided by the Customer. Such confirmation message will contain the data entered in the Order by the Customer, so that the Customer can verify the same and, if necessary, promptly communicate the necessary corrections of incorrect data.

3. Prices and Payment Methods

3.1 Prices shown on the site are inclusive of taxes and VAT. Shipping costs are communicated in advance to the Customer through the site or these Conditions.

3.2 The following payment methods are provided:

(I) PayPal For payment, the Paypal circuit can be used by the customer in accordance with its specific terms.

(II) Credit Card In cases of purchase of the goods with Credit Card payment method, the transaction may take place through the secure server Stripe, or other secure server chosen by Simplicitas.
Under no circumstances and at no stage of the payment will Simplicitas be able to know the information relating to the Customer’s credit card, transmitted via secure connection directly to the website of the banking institution handling the transaction. No computer file of Simplicitas will retain such data and therefore under no circumstances Simplicitas can be held liable for any fraudulent and improper use of credit cards by third parties at the time of payment.

(III) Wire Transfer
When purchasing by wire transfer, the bank details for payment will be displayed. The goods will be shipped only upon actual receipt of payment in the bank.

4. Delivery of products and related expenses

4.1 Orders are processed within 48 hours of receipt and shipped by noon Monday through Friday. Products purchased will be delivered to the address indicated by the Customer in the Order within 24-48 hours of Simplicitas’ acceptance of the Order, at the cost specifically stated on the Site prior to placing the Order. Simplicitas reserves the right to accept or not accept deliveries requested outside the borders of Italy or Europe. In any case, for deliveries to be made outside Italian borders, shipping costs and delivery times may vary.

4.2 With respect to deliveries required to countries outside the European Union, any import customs charges will be borne by the consignee. Therefore, the Customer is encouraged to contact the customs authorities in his or her country in advance to verify the costs and any import limits.

4.3 The delivery times indicated by Simplicitas are to be considered purely indicative and a delay with respect to the same, or any delivery made in successive split shipments shall not entitle the Customer to the refusal of the same delivery and the claim for compensation or indemnity.

4.4 At the time of delivery of the products, the Customer is required to check:
that the number of packages being delivered corresponds to what is indicated in the transport document.
That the packaging is intact, undamaged, not wet or otherwise altered, including in the sealing materials (adhesive tape or other).

4.5 Any damage to the packaging and/or the product or the mismatch of the number of packages or indications, must be immediately detected, by making a specific indication on the delivery document of the product to be returned to the courier.
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 48 hours after delivery, to the email address: orders@simplicitascollection.com

4.6 The cost of shipping to Europe is €20.00.

4.7 Shipping on clothing is always free in Italy, the cost of shipping accessories is € 5.50 in Italy. As soon as the ‘order is shipped, the Customer will receive an email notification of successful shipment containing the tracking code to check the status of delivery. 5. Right of withdrawal

5.1 Pursuant to Art. 52 of Legislative Decree. 206/2005, as amended by Leg. 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 In order to exercise the right of withdrawal, the Customer must send Simplicitas a notice to that effect, within the specified time limits, to the following email address: info@simplicitascollection.com with FORM attached, completed in its entirety.

5.3 In the event of withdrawal, the Customer must resend, with shipping costs borne by the Customer, the products to Simplicitas within 14 (fourteen) days of such withdrawal, to the following address:

5.4 The goods must be returned undamaged, complete with all its parts and in its original packaging, kept and possibly used for the time strictly necessary to establish and verify its nature, characteristics and size, according to normal diligence, without any signs of wear or dirt taking care not to leave any traces of makeup and / or fragrances, in accordance with the conditions below:

5.5 The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, accessories, etc. …);
For withdrawal to be possible, the product must be intact, clean and odorless and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc.);
in case of damage to the property during transport, Simplicitas will notify the Customer, to enable him to file a timely complaint against the courier chosen by him and obtain a refund; the product will then be made available to the Customer, simultaneously canceling the request for withdrawal; Simplicitas will not respond in any way for damage, theft, loss occurring during or otherwise in dependence of the shipment for return.

5.6 The right of withdrawal may not apply to products for which the customer has requested customization.

5.7 Simplicitas will refund to the Customer the amount of the product already paid, excluding shipping costs, within 30 (thirty) days from the withdrawal, by means of a transfer procedure of the amount charged, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed.

5.8 In any case, the Customer shall forfeit the right of withdrawal in cases where Simplicitas ascertains that: the returned product shows obvious signs of use, dirt or odors;
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its outer packaging and/or its original inner packaging;
the product is missing integral elements thereof and/or accessories (e.g., closures, laces, buckles, etc.).
In the event of forfeiture of the right of withdrawal, Simplicitas will return the purchased product to the sender, charging the sender the shipping costs and, where already refunded, the price of the product.

6. Size change

6.1 In case of return – size change, the Customer shall send Simplicitas a communication to that effect, within 14 (fourteen) working days from the date of receipt of the products, to the following email address: info@simplicitascollection.com with FORM attached, completed in its entirety. The customer will receive via email (entered during registration) the procedure to follow.

6.2 This procedure is allowed only if you wish to exchange the same product for a different size. The size change can be made only once. The return – size change may not apply to products for which the customer has requested customization. Shipping costs are the responsibility of Simplicitas.

6.3 If, on the other hand, you wish to exchange a product for a different item, this procedure is not allowed. It will be necessary to proceed with contract termination and place a new order.

6.4 For the return – size exchange to be possible, the product must be intact, clean and odorless and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc.).

6.5 In any case, the Customer will forfeit the right of return – size exchange in cases where Simplicitas ascertains that: the returned product shows obvious signs of use, dirt or odors;
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its outer packaging and/or its original inner packaging;
the product is missing integral elements thereof and/or accessories (e.g. closures, laces, buckles, etc.).
In case of forfeiture of the right of return – size change, Simplicitas will return the purchased product to the sender, charging the sender for the shipping costs.

8. Privacy

8.1 Personal data collected by placing an Order will be processed by Simplicitas for the sole purpose of fulfilling the express requests of the Customer, in accordance with European Regulation 679/2016 and the privacy policy on the website. Any further processing will be carried out only with the express consent of the Client.

9. Applicable law

9.1 The contract of sale referred to in these Conditions and its execution and governed by Italian Law, with the disapplication of the conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer’s municipality of residence shall have jurisdiction to resolve the relevant disputes.

10. Alternative dispute resolution

10.1 Pursuant to and in accordance with Art. 14 of EU Regulation No. 524/2013, consumers residing in the states belonging to the European Union are hereby informed that for the resolution of disputes relating to this contract and the online services offered by this site, there is the possibility of resorting to the Online Dispute Resolution (ODR) procedure, provided by the European Commission, and accessible at the following link: https://ec.europa.eu/consumers/odr/.
